Le immagini presenti su questo sito e diffuse sui canali social di Luca Libralato sono coperte dal diritto d’autore. L’utilizzo non autorizzato costituisce una violazione del diritto d’autore e può essere perseguito a fini di legge, sia tramite ingiunzione di cessazione e desistenza, che di richiesta di risarcimento danni (verso i beneficiari dell’utilizzo).
L’utilizzo delle immagini per fini personali deve essere autorizzato e sempre corredato dai crediti.
L’utilizzo delle immagini per fini commerciali è consentito solo previo ottenimento di una opportuna licenza d’uso che copra le finalità previste.
La proprietà delle immagini resta sempre dell’autore, anche dopo l’acquisto di una licenza d’uso. Con l’acquisto di una licenza d’uso verranno fornite le condizioni di acquisto, tra cui l’utilizzo specifico che potrà essere fatto dell’immagine in termini di formato, finalità e territori consentiti.
Costo della licenza
L’ammontare del costo della licenza d’uso dipenderà dalle finalità e dal tiraggio dell’utilizzo. Il valore verrà calcolato tramite l’applicazione di tariffe di mercato (valutate attraverso siti di riferimento del settore) in funzione delle informazioni fornite dall’acquirente.

Licensing
All images on this website and social network channels of the author are intellectual property of Luca Libralato and covered by copyright. Unauthorized use of these images constitutes copyright infringement and shall entitle the author to exercise all rights and remedies under applicable copyright law, including an injunction to cease or desist (preventing further use) and request for monetary damages against all users and beneficiaries of the use of such images.
Personal usage of images must be pre-authorized and always with visible credits.
Editorial and commercial usage of images must be licensed with a proper licensing agreement which covers the specific usage.
The copyright of the image is always retained by the photographer. When an image is licensed, there will be standard terms and conditions (that will be sent to the licensee by email once the license has been agreed) outlined with specific usage rights. When an image is licensed, the usage is specified on the invoice (or specific contract) and cannot be used for any other purpose without further agreement with the author. The license will state the media use, language rights and the territories for the usage.
Usage fee
A fee is generally payable to license any rights managed image. The fee is based on how the image is going to be used. This will be calculated by such factors as the print run, media, the reproduction size, and territory distribution and whether the requested use is exclusive or non-exclusive. Fee will be calculated by relying in good faith on the information provided by the licensee. Incorrect information can lead to a surcharge on the originally agreed fee and may lead to a cancellation of the license.

No unlawful use
The license does not allow for images to be used in connection with anything illegal or in violation of any applicable regulations or law. Using images in pornographic or defamatory contexts is also not permitted. Even with a commercial license, our images cannot be used in a trademark or a logo. Also images cannot be redistributed as a standalone file.
